ILEX stands for International Litigation Exchange. ILEX is a new think tank for the exchange and promotion of legal ideas concerning international and cross-border litigation. ILEX focusses on court litigation in complex, multi-jurisdictional disputes as a result of increasingly international business relations. ILEX seeks to address all kinds of legal, procedural and practical challenges of international dispute resolution and aims at discussing topical issues as well as the wider theoretical and practical foundations of international disputes. The exchange of ideas and the events organized by ILEX provide a forum for legal practitioners, academics and decision-makers in Germany and beyond interested in international litigation.

 

ILEX is an initiative by German lawyers working in international law firms and inhouse counsel involved in cross-border litigation. Its founders are Alexandra Diehl (White & Case), Heiko Heppner (Dentons), Clemens-August Heusch (Nokia), Roland Kläger (Haver & Mailänder), Anke Meier (Noerr), Miriam Nabinger (Fresenius Medical Care) and Jan Schäfer (King & Spalding).

About ILEX

ILEX is a think tank for the exchange and promotion of legal ideas concerning international and cross-border litigation. ILEX focuses on court litigation in complex, multi-jurisdictional disputes as a result of increasingly international business relations. More specifically, ILEX seeks to address issues such as the interaction of attorneys and courts, the cross-border cooperation of legal counsel, litigation-related national law and policy making, matters affecting the perception of a jurisdiction’s courts and its impact on international choice of forum scenarios, the impact of major political decisions (such as BREXIT) on cross-border litigation, as well as any and all other kinds of legal, procedural and practical challenges of international dispute resolution. ILEX aims at discussing topical issues as well as the wider theoretical and practical foundations of international disputes.

 

ILEX members are legal practitioners working in a wide variety of litigation-related settings: They are judges, trial attorneys and administrative officials, as well as inhouse counsel and academics. ILEX members practice in all areas that give rise to or are associated with cross-border litigation, from corporate, commercial contract and securities law to intellectual property, competition, insolvency, criminal, administrative law and beyond. ILEX welcomes individual as well as corporate, and German as well as international members. The exchange of ideas and the events organized by ILEX thus provide a forum for legal practitioners, academics and decision-makers in Germany and beyond who are interested in international litigation.

 

ILEX is a registered association (“eingetragener Verein”) pursuant to German law, headquartered in Frankfurt. It is governed by a four-person Board of Directors, who in the day to day handling of ILEX’s affairs are joined by a group of additional managing members.

 

ILEX’s first events included its very well-received November 2016 Inaugural Conference, which shone a spotlight onto the status quo of Germany’s position as a forum for international litigation; as well as two less formal meetings in March and May 2017, one of which featured a presentation and subsequent discussion of issues relating to government searches performed in law offices and the resulting concerns with regard to the protection of privileged information and documents.

 

While these first three events took place in Frankfurt – and Frankfurt will continue to house major ILEX events in the future – meetings and other events will also be taking place in other locations, such as Stuttgart, Düsseldorf or Cologne.

 

Future events may focus on issues such as:

  • The impact of BREXIT on international litigation,

  • The interrelation and relative importance of state court litigation on the one hand and arbitration on the other hand in international dispute resolution,

  • Germany’s perception as a cross-border litigation forum with trial and inhouse counsel in other, particularly in common law jurisdictions,

  • Statutory and case law issues operating as de facto impediments to a wider acceptance of Germany as a forum for cross-border litigation (e.g., limitations placed on the enforceability of standard corporate terms and conditions), and

  • Attorney remuneration and fee issues in connection with cross-border litigation.
